Last month the Second Circuit Court of Appeals reversed the U.S. District Court's decision to deny the New York State Psychiatric Association standing in its claim against UnitedHealth Group and related entities . In doing so, the court opened the doors for member associations to bring claims on behalf of its members for violations of federal law.

Eighth Circuit Upholds FERC Rule on Co-op Avoided Cost Rates

The U.S. Court of Appeals for the Eighth Circuit has upheld the long-standing determination by the Federal Energy Regulatory Commission that the avoided cost rate paid by a distribution cooperative for energy purchased from a qualifying cogeneration or small power production facility is the same as the avoided cost rate of the distribution co-op's generation and transmission all-requirements supplier. In doing so, the Eighth Circuit did not break any new ground.
