Apple files appeal against e-book injunction

(Telecompaper) Apple has filed a notice with the Second Circuit Court of Appeals in New York, stating its intent to appeal both a July ruling by US District Judge Denise Cote, that found it had worked in collaboration with the major book publishers to raise e-book pricing, and the sanctions that followed in a 6 September injunction, reported AllThingsD. "Apple also hereby appeals from any and all orders and rulings that were adverse to it," the company said in its notice. Apple did not comment on the filing but it is expected the company's argument will be that the DOJ failed to meet its burden of proof in the case and also overreacted by seeking to prosecute Apple for legitimate business practices. As lead counsel Orin Snyder said in his closing arguments, "Apple did not conspire with a single publisher to fix prices in the e-book industry. All of the government's evidence is ambiguous at best...its case is built on word games and inferences".

Judge Brown said the arguments by the plaintiffs failed to show that the labeling rules would cause irreparable harm to their member companies and livestock producers. read more
