A U.S. appeals court on Thursday said Apple should have been awarded an injunction barring Samsung from selling products that infringe its patents, handing Apple another victory in its ongoing smartphone fight with its biggest rival. The U.S. Court of Appeals for the Federal Circuit in Washington, D.C. said the lower court abused its discretion when it denied Apple Inc an injunction after a jury ordered Samsung Electronics Co Ltd to pay $120 million in May, 2014 for infringing three of Apple's patents.

Apple wins court order to block features in Samsung phones

(Telecompaper) Apple won a court ruling that may force Samsung Electronics to stop using some features in its smartphones and tablets. A US appeals court said Apple was entitled to a narrow order that prevents Samsung from using Apple's slide-to-unlock, autocorrect and quicklinks features, Bloomberg reports. Samsung said it would ask that the issue be considered by all active judges of the Federal Circuit, since it was a split decision by the US Court of Appeals in Washington. The court handles all patent appeals. The ruling applies to older models at Samsung including the Galaxy S2 and Note 2, so it is unlikely to have a significant impact on the company's business. The latest decision follows a win by Apple in May 2014 against Samsung, which was found to have infringed Apple's patents for the slide-to-unlock, autocorrect and quicklinks features. At that time, the trial judge declined to force Samsung to remove the features from its mobile phones, saying monetary damages would be adequate. Apple argued that, if it weren't able to control use of its inventions, it may lose market share and its reputation as an innovator. Samsung is appealing the underlying infringement verdict; that case is pending before the Federal Circuit.

Samsung wins appeal against Apple claim of iPhone copying

(Telecompaper) A US federal appeals court handed a partial victory to Apple, ruling Samsung infringed the iPhone maker's intellectual property but setting aside part of a USD 930 million jury award. The US Court of Appeals for the Federal Circuit, which handles patent lawsuit appeals, affirmed a jury's findings that Samsung infringed several Apple patents. The appeals court, however, ruled against Apple's so-called "trade dress" claims related to the distinctive look of the iPhone, the Wall Street Journal reports. The appeals court sent the case back to the trial level for the damages award to be reduced for the portion of the case Apple lost on appeal. Samsung had been seeking to have the jury award lowered by USD 382 million because of the jury's trade-dress findings that Samsung argued were erroneous. The appeals court battle came after an August 2012 trial in San Jose in which a federal jury found that a range of Samsung devices, including the Galaxy S II and the Droid Charge, infringed Apple's patents. Jurors originally awarded USD 1.05 billion in damages, but that figure was reduced to USD 930 million after the judge called for a retrial on some damages issues.
