Belgian privacy regulator asserts authority over Facebook

2015-05-18 09:32:00| Telecompaper Headlines

(Telecompaper) The Belgian Privacy Commission has confirmed that Facebook is in violation of local laws on personal data protection and announced plans to investigate the social network further. The Belgian regulator and its Dutch and German counterparts have been investigating Facebook since 2015; the French and Spanish regulators also recently joined the group. While Facebook claims it is only subject to oversight by the data commissioner in Ireland, where its European office is based, the Belgian regulator has now asserted its authority over the US-based company, saying Belgian law applies because Facebook has a small office in the country. The Belgian Privacy Commission issued recommendations following its preliminary investigation and based on an earlier released academic study it commissioned into Facebook's privacy policy. The recommendations are based on just one of the ten issues highlighted in the report, the use by Facebook of website plug-ins to track browsing behaviour of both Facebook members and non-members of the social network. As it does not ask prior permission to use cookies to track visitors to the site, it is in violation of Belgian and EU privacy law. Facebook has to date rejected the authority of the Belgian regulator and the findings of its study. The regulator called for Facebook to change its policies to bring it in line with EU law, recommended that other websites that use Facebook plug-ins adopt an opt-in system for cookie tracking and called for internet users to use browser add-ons that block tracking and allow for 'incognito' browsing. The Belgian regulator said it aims to investigate thoroughly each of the privacy issues raised in the study into Facebook's policies.

Dutch threaten Facebook with fine over privacy investigation

2015-05-06 11:19:00| Telecompaper Headlines

(Telecompaper) The Dutch privacy regulator (CBP) said it will fine Facebook for not providing all the information the regulator requested, for its investigation into Facebook's privacy policy, the NOS reported. Facebook responded that it will provide further information on part of the CBP's question about the regulator's jurisdiction and the applicability of the country's privacy rules. CBP will wait to impose the fine after evaluating the information. At the end of last year, the CBP said it would look into Facebook's privacy policy. The investigation was prompted by the company's announcement of new privacy conditions for Facebook users from January. The privacy policy went into effect on 30 January. The CBP wants the requested information to determine its jurisdiction and the applicability of the Data Protection Act (Wbp). The regulator had asked Facebook to delay the implementation of its new privacy policy until the investigation was over. The privacy policy gave Facebook the right to use information and photos in user profiles for commercial purposes.

2015-04-30 09:34:00| Telecompaper Headlines

(Telecompaper) US legislators have introduced a bill in Congress aimed at strengthening the digital privacy of students, the New York Times reported. Entitled the Student Digital Privacy and Parental Rights Act of 2015, the bill would prohibit operators of websites, apps and other online services from knowingly selling students' personal information to third parties, for kindergartners through 12th graders. The act would also forbid the use or disclosure of their personal information for tailored advertising and for the creation of personal profiles, unless it is for a school-related purpose. The bill would give parents access to information held about their children and allow them to correct or delete any information about their children, as well as to download any material their children have created.
