OTE to sell satellite unit to Arabsat for EUR 208 mln

(Telecompaper) Greek operator OTE has agreed to sell its satellite unit Hellas Sat to Saudi Arabia-based Arabsat for EUR 208 million. The deal values the company at EUR 157 million, or 7 times EBITDA for 2012, plus Hellas Sat's cash of EUR 53.4 million. OTE CEO Michael Tsamaz said in a statement said that the value of the deal was "satisfying". The transaction is expected to be completed in the second quarter, pending regulatory approval. Hellas Sat has the exclusive use of the orbital position of 39 degrees East and all associated radio frequencies from Greece and Cyprus. It operates the Hellas-Sat 2 satellite, with wide coverage of Europe, the Middle East and South Africa. The company has over 100 customers in 26 countries.
Portugal Telecom, Telefonica fined EUR 79 million by EU

(Telecompaper) Portugal Telecom and Telefonica have received a total fine of EUR 79 million from the European Commission as the result of a non-competition agreement by the operators. The European Commission said that the non-competition clause, valid from September 2010 to February 2011, was contrary to EU law, pointing out it will not tolerate anti-competitive practices by incumbent operators. The EC fined Portugal Telecom EUR 12.3 million and Telefonica EUR 66.9 million. The operators agreed to not compete against each other in Spain and Portugal when they reached agreement in 2010 for Telefonica to take full control of their Brazilian joint venture Vivo. The non-competition agreement was ended in 2011 when the EU opened its anti-trust investigation.
KPN fined EUR 8.5 mln after losing court appeal

(Telecompaper) Dutch regulator Opta has issued fines totaling around EUR 8.5 million against KPN. The fines were first levied in February 2010, but became unconditional on 09 January following a ruling by the corporate appeals court (CBb). The court did lower the value of the fines, from an original amount of around EUR 10 million, after canceling some of the levies for repeat offences. KPN's appeal was otherwise rejected, and the court affirmed Opta's decision that KPN gave illegal discounts to six large corporate customers in the period 2004-06. KPN also demanded the right to be invited first to pitch for new tenders and to undercut offers from rival providers. Opta also found recidivism for some of the offences.
