New York attorney Kenneth Eland has filed a shareholder derivative lawsuit against AT&T's officers and directors, reports the Dallas Morning News , "alleging that they knew or should have known that a billing practice called 'cramming' was illegal and would harm the business." The lawsuit lists AT&T Chief Executive Randall Stephenson among the defendants, alleging that he and others breached their fiduciary duty to the company "by causing or allowing significant control gaps in the company's anti-cramming program."
