(Telecompaper) Telefonica Czech Republic filed a lawsuit at the City Court in Prague over the conditions of the auction for frequencies in the 800, 1,800 and 2,600 MHz bands. According to Telefonica, the regulator CTU intends to implement several discriminatory and unlawful measures, claiming a need to strengthen the competitive environment in the Czech telecommunications market. The operator's main objection is the reservation of frequencies in the 800 MHz band for a new market player. Telefonica said that the public authorities need to justify the restrictive and discriminatory measures and prove they pursue a legitimate objective that does not go beyond what is necessary or that less restrictive alternatives are available. In addition, Telefonica opposes the obligations for spectrum winners to provide national roaming and wholesale offers to a new player for a period of twelve years.
