In Patent Litigation, Justice Delayed Ensures the Entire Public Can Be Denied

When courts fail to quickly address serious defects in a patent litigation complaint, it can harm not only the parties to the case, but also the public at large. Yesterday, EFF and Public Knowledge filed a friend-of-the-court brief with the Court of Appeals for the Federal Circuit in a case where the Eastern District of Texas is allowing expensive litigation to drag on even though the defendant has already fully briefed validity issues that almost surely will dispose of the case, and stop the patent owner from suing on them in the future.

AF&PA President Donna Harman and American Wood Council President Robert Glowinski issued statements after filing joint petition for review in the D.C. Circuit Court of the EPA's treatment of biomass energy in the final Clean Power Plan. According to Harman, plan does not put biomass on a level playing field with other renewable energy sources. Glowinski says rule may place unnecessary restrictions on use of biomass energy as part of plan to reduce CO2 emissions from electric power generation.

Celgene Corp said it would allow for the sale of a generic version of its flagship multiple myeloma drug, Revlimid, in the United States over a year before patents covering the drug expire. The company said it would provide India-based Natco Pharma Ltd and its U.S. partner, Arrow International Limited, a unit of Allergan Plc, the license to Celgene's patents required to manufacture and market an unlimited quantity of generic Revlimid beginning Jan. 31, 2026 as part of a patent litigation settlement.

Ericsson, Apple to develop 5G phones and end litigation

Swedish telecoms firm Ericsson AB has inked a 7-year deal with Apple Inc. that brings an end to outstanding mutual patent litigations between the two and paves the way for their joint-development of the next generation of super-fast phones. Ericsson, the world's largest wireless equipment maker, did not reveal terms of the deal Monday but said it includes a cross-license that covers patents owned by both companies, including the GSM, UMTS and LTE standards used in mobile technology.
