Stratford is suing a U.S. guardrail manufacturer for a hefty $500 million for providing the city with an allegedly dangerous and defective designed guardrail. The city's claim, which was obtained by ABC News during their investigation of the company's ongoing troubles, alleges that Trinity Industries of Dallas "misled its customers" by not divulging "secret" alterations it had made to its ET-Plus guardrail system.

The multi-million dollar troubles for an embattled American guardrail maker have extended north of the border as a Canadian city filed a lawsuit this week over the company's allegedly dangerous and "defective" guardrail design. The complaint, obtained by ABC News, seeks half a billion dollars in damages on behalf of the city of Stratford, located in Ontario, Canada and alleges Trinity Industries of Dallas, the manufacturer of the ET-Plus guardrail system, "mislead its customers" by not disclosing "secret" modifications it had made to its product.

An affidavit filed by Trinity expert witness Malcolm Ray hits back against recent comments that a test of the ET-Plus guardrail head demonstrated an impact that would have caused severe injury to a driver. The guardrail got a "pass" grade on the first four of eight government-requested tests and appeared to sail through the next three as well, but civil engineer and accident expert Brian Coon declared the eighth appeared to be a "clear failure" in an affidavit filed earlier this month.

The debate over the safety of the ET Plus Guardrail has been growing recently, ever since new crash tests were released and a lawsuit was filed against the maker of the guardrail, Texas-based Trinity Industries Inc. Josh Harman, who has spent 25 years in the guardrail installation business, filed a federal whistleblower case against Trinity. He accused the company of making changes to its guardrail heads, also known as endcaps, and not telling the federal government about the changes.
